These Terms of Service ("Terms") govern your access to and use of the digital platforms, websites, SMS and messaging services, mobile tools, applications, and communication channels operated by World Central Kitchen Inc. ("WCK," "we," "our," or "us"), including those supporting the Innovation Kitchen, ANDRES, WCKLab, ChefConnect, SitRep, and any associated pilot tools (collectively, the "Services").
By accessing or using the Services—including via SMS, WhatsApp, RCS, voice, or IVR—you agree to be bound by these Terms. If you do not agree, discontinue use of the Services.
1. Purpose of the Services
WCK builds technology to support community-led disaster response, including coordination of meals, supplies, services, assessments, and communication during emergencies.
The Services are designed to:
- Connect local responders, chefs, NGOs, volunteers, and community members
- Enable two-way communication during a disaster
- Provide situational awareness and resource coordination
- Support safe, ethical, and secure humanitarian operations
The Services are not intended for personal emergencies or life-saving communications.
2. Eligibility
You may use the Services only if:
- You are at least 18 years old (or the age of majority in your jurisdiction), or
- You are participating through a WCK-partner organization, and
- You have the authority to enter into these Terms
Some features may require identity verification or additional documentation.
3. Consent to Communications (SMS, WhatsApp, RCS, Voice, Email)
By providing your phone number or email and opting in—via form, SMS reply, WhatsApp message, or verbal confirmation—you consent to receive WCK communications related to disaster operations.
3.1 Opt-In Requirements
You must expressly opt in using one of the following:
- Checking an online opt-in box
- Texting a keyword (e.g., "YES", "START")
- Replying affirmatively to a confirmation message
- Completing a WCK onboarding or registration flow
- Scanning a WCK QR code with clear opt‑in language
3.2 Opt-Out Methods
You may opt out at any time by replying:
- STOP to SMS
- STOP or using WhatsApp's native tools
- STOP to RCS
- Emailing privacy@wcklab.org
You will receive a confirmation and no further non-emergency messages.
3.3 Message Frequency & Costs
Message frequency varies based on disaster activity and your role. Message and data rates may apply. For assistance with messaging, you can reply HELP or email privacy@wcklab.org.
4. Acceptable Use
You agree not to use the Services to:
- Submit false information or impersonate an individual
- Interfere with or disrupt the Services
- Upload unlawful, harmful, or abusive content
- Violate privacy or data protection expectations
- Spam or misuse communication channels
- Submit malware or automated scraping
- Engage in fraud, including false claims
- Violate Twilio, WhatsApp, OneReach, RCS, carrier, or governmental policies
WCK may suspend or terminate access for misuse.
5. User-Provided Content
You may submit information, photos, geolocation data, check-ins, meal counts, or other content ("User Content").
By submitting User Content, you grant WCK a non-exclusive, worldwide, royalty-free license to use it for operational, humanitarian, research, and analytical purposes.
You represent that User Content is accurate, lawful, and permissible to share.
6. Privacy
WCK collects and processes data as described in our Privacy Policy (published separately). Our approach emphasizes:
- Data minimization
- Purpose limitation
- Ethical stewardship
- Community trust
WCK may share operational data with trusted partners when necessary for humanitarian response.
7. Intellectual Property
All materials—text, graphics, code, models, data schemas, logos, and features—are the property of World Central Kitchen Inc. or its partners.
You may not:
- Copy or modify Service content
- Reverse-engineer the Services
- Use trademarks without express written permission
A limited, revocable, non-transferable license is granted solely for participation in disaster-response activities.
8. Availability & Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind.
WCK does not guarantee:
- Continuous availability
- Delivery of messages
- Accuracy of maps, predictions, or third-party data
- Freedom from outages or disruptions
WCK is not responsible for: carrier failures, network outages, incorrect geolocation, or user configuration errors. Carriers are not liable for delayed or undelivered messages.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WCK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, INCOME, PROFITS, USE, OR OPPORTUNITIES.
WCK'S TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS (USD $100).
10. Changes to the Services or Terms
We may update these Terms periodically. When updates are material, we will notify you via email, SMS/WhatsApp, in-app notice, or website announcement.
Continued use constitutes acceptance of revised Terms.
11. Termination
WCK may suspend or terminate access if:
- You violate these Terms
- You misuse communication tools
- Your information is false
- Fraud or safety concerns arise
You may delete your account or opt out of communications at any time.
12. Governing Law
These Terms are governed by the laws of District of Columbia. Disputes shall be resolved in courts located within that jurisdiction.
